Temporary or Urgent Domestic Violence Protection Orders

What if you need to get a Temporary or Urgent Domestic Violence Protection Order

Under the legislation which has applied in Queensland from 17 September 2012, a Court might make an urgent Temporary Protection Order before the Respondent is served with the Application, if the Court is satisfied that the making of a temporary protection order is necessary or desirable to protect the Aggrieved or a “named person” from domestic violence.

The position is similiar in most other Australian States.

Under the legislation which applied until 17 September 2012 in Queensland, a Court might have made an urgent Temporary Protection Order before the Respondent is served with the Application if the Aggrieved or a “named person”:

  • was in danger of being injured; or
  • property of the Aggrieved or a “named person” is in danger of substantial damage.
